{"id":1722,"date":"2023-02-13T12:57:00","date_gmt":"2023-02-13T17:57:00","guid":{"rendered":"https:\/\/www.merkley.senate.gov\/merkley-wyden-colleagues-introduce-bicameral-bill-requiring-scotus-to-follow-code-of-ethics\/"},"modified":"2023-08-28T15:07:33","modified_gmt":"2023-08-28T19:07:33","slug":"merkley-wyden-colleagues-introduce-bicameral-bill-requiring-scotus-to-follow-code-of-ethics","status":"publish","type":"post","link":"https:\/\/www.merkley.senate.gov\/es\/merkley-wyden-colleagues-introduce-bicameral-bill-requiring-scotus-to-follow-code-of-ethics\/","title":{"rendered":"Merkley, Wyden y sus colegas presentan un proyecto de ley bicameral que exige que SCOTUS siga el c\u00f3digo de \u00e9tica"},"content":{"rendered":"<p>Washington, D.C. \u2013 Oregon\u2019s U.S. Senators Jeff Merkley and<br \/>\nRon Wyden joined their Senate and House colleagues to introduce <i>the Supreme<br \/>\nCourt Ethics Act<\/i>, requiring the Judicial Conference of the United States to<br \/>\ncreate a code of ethical conduct for the Supreme Court of the United States.<br \/>\nThe legislation would also require the appointment of an Ethics Investigations<br \/>\nCounsel and require justices to publicly disclose recusal decisions.<\/p>\n<blockquote>\n<p>\u201cThe Supreme Court is making life-altering decisions<br \/>\nthreatening Americans\u2019 reproductive rights, workers\u2019 bargaining power, voting<br \/>\nrights, clean air, and so much more\u2014yet, unlike other federal judges, they have<br \/>\nno restrictions on their conflicts of interest,\u201d <b>said Senator Merkley.<\/b><br \/>\n\u201cStrengthening the code of ethics for the Supreme Court protects our democracy<br \/>\nand helps ensure that the highest court in our \u2018We the People\u2019 democracy works<br \/>\nfor the people, not just the powerful.\u201d<\/p>\n<p>\u201cThe highest ethical standards and our nation\u2019s highest<br \/>\ncourt must go hand in hand,\u201d <b>Wyden said.<\/b> \u201cThis legislation ensuring that<br \/>\nhappens by applying the same code of ethics to the nine justices that all other<br \/>\nfederal judges live by would give all Americans confidence that Supreme Court<br \/>\ndecisions are free from conflicts of interest.\u201d<\/p>\n<\/blockquote>\n<p>The <i>Supreme Court Ethics Act<\/i> would:<\/p>\n<ul>\n<li>Create a statutory requirement for the Judicial Conference<br \/>\nof the United States to issue a code of conduct that applies to the Supreme<br \/>\nCourt; <\/li>\n<li>Direct the Supreme Court to appoint an Ethics Investigations<br \/>\nCounsel who will establish a process for the public to report information about<br \/>\npotentially unethical conduct by the Justices and to issue a public annual<br \/>\nreport on the disposition of allegations and investigations; <\/li>\n<li>Empower the Ethics Investigations Counsel to conduct their<br \/>\nown investigations into potential violations of the code of conduct; <\/li>\n<li>Require Justices who recuse themselves from a case to<br \/>\npublicly disclose the reason; <\/li>\n<li>Require Justices who deny a proper motion to recuse to<br \/>\npublicly disclose the reason.<\/li>\n<\/ul>\n<p>This legislation was led by U.S. Senator Chris Murphy<br \/>\n(D-Conn.) and U.S. Representative Hank Johnson (D-Ga.). Alongside Wyden and<br \/>\nMerkley, the bill was cosponsored by U.S. Senators Richard Blumenthal (D-Conn.),<br \/>\nCory Booker (D-N.J.), Bob Casey (D-Pa.), Dick Durbin (D-Ill.), Ed Markey<br \/>\n(D-Mass.), Patty Murray (D-Wash.), Tammy Baldwin (D-Wis.), Sherrod Brown<br \/>\n(D-Ohio), Ben Cardin (D-Md.), Tom Carper (D-Del.), Catherine Cortez Masto<br \/>\n(D-Nev.), Tammy Duckworth (D-Ill.), John Fetterman (D-Pa.), Dianne Feinstein<br \/>\n(D-Calif.), John Hickenlooper (D-Colo.), Amy Klobuchar (D-Minn.), Ben Ray Luj\u00e1n<br \/>\n(D-N.M.), Gary Peters (D-Mich.), Bernie Sanders (I-Vt.), Jeanne Shaheen<br \/>\n(D-N.H.), Tina Smith (D-Minn.), Debbie Stabenow (D-Mich.), and Chris Van Hollen<br \/>\n(D-Md.).<\/p>\n<blockquote>\n<p>\u201cEvery federal judge is bound by a code of ethics \u2013 except<br \/>\nfor the nine who sit on the highest court in the country. Trust in the Supreme<br \/>\nCourt is at a historic low because the American people see justices hide their<br \/>\nconflicts of interest and openly engage in political behavior. This legislation<br \/>\nwould help restore some lost faith by requiring the Judicial Conference to<br \/>\ncreate a code of ethics for Supreme Court justices. It\u2019s a simple, non-partisan<br \/>\nsolution to increase transparency, enforce accountability, and start to rebuild<br \/>\npublic confidence in the Court,\u201d <b>said Sen. Chris Murphy<\/b>.<\/p>\n<p>\u201cThis isn\u2019t a conservative-liberal justice problem \u2013 it\u2019s an<br \/>\nAmerican Democracy [capital D] problem when the court regularly faces<br \/>\nchallenging ethical questions, and because of their crucial and prominent role,<br \/>\nthe justices receive intense public scrutiny for their choices,\u201d <b>said Rep.<br \/>\nHank Johnson, ranking member of the House Judiciary subcommittee on courts. <\/b>\u201cAs<br \/>\nwe read more and more about the dealing of the court, it continues to show us<br \/>\nwhat\u2019s going on behind the curtain, more and more of my colleagues on both<br \/>\nsides of the aisle will be calling for justices to bind themselves to a code of<br \/>\nethics.\u201d&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;<\/p>\n<p>\u201cThe Supreme Court of the Unites States ought to be the<br \/>\nembodiment of objectivity. As reports of ethically questionable behavior by<br \/>\nJustices continue to surface, Congress must close the inexcusable \u2018Supreme<br \/>\nCourt loophole\u2019 in federal judicial ethics rules by creating and enforcing a<br \/>\ncode of ethics for Supreme Court Justices.
