{"id":1992,"date":"2022-09-10T14:05:00","date_gmt":"2022-09-10T18:05:00","guid":{"rendered":"https:\/\/www.merkley.senate.gov\/merkley-steps-up-for-prep-users\/"},"modified":"2023-07-24T11:04:51","modified_gmt":"2023-07-24T15:04:51","slug":"merkley-steps-up-for-prep-users","status":"publish","type":"post","link":"https:\/\/www.merkley.senate.gov\/es\/merkley-steps-up-for-prep-users\/","title":{"rendered":"Merkley Steps Up for Prep Users"},"content":{"rendered":"<p>Thursday, Oregon&#8217;s U.S. Senator Jeff Merkley and Tina Smith<br \/>\n(D-MN) were joined by Senators Chris Van Hollen (D-MD), Elizabeth Warren<br \/>\n(D-MA), Bernie Sanders (I-VT), Tammy Baldwin (D-WI), Edward J. Markey (D-MA),<br \/>\nand Cory Booker (D-NJ) in a letter to AHIP, the trade association representing<br \/>\nhealth insurance companies. The letter expresses concerns about the continued<br \/>\npractice of unlawfully charging individuals for pre-exposure prophylaxis (PrEP)<br \/>\nmedication and related care.&nbsp;<\/p>\n<p>The Senators&#8217; letter follows a Wednesday court ruling that<br \/>\nfurther threatens affordable access to PrEP. As the legal process moves<br \/>\nforward, the Senators pressed the health insurance industry to abide by current<br \/>\nlaw to provide medication and ancillary services without charge.&nbsp;<\/p>\n<p>&#8220;It has been brought to our attention that enrollees in<br \/>\nyour members&#8217; health plans continue to be charged for necessary medications and<br \/>\nancillary services-including provider consultations and laboratory<br \/>\nservices-contrary to law and additional federal guidance issued by the<br \/>\nDepartments of Labor, Health and Human Services, and Treasury,&#8221; wrote the<br \/>\nSenators. &#8220;We write to express our deep concern with these erroneous and<br \/>\nunlawful charges, and to request additional information on steps that AHIP is<br \/>\ntaking to ensure that its members adhere to federal law and ensure the PrEP<br \/>\ndrugs and the full scope of PrEP ancillary services are offered without charge<br \/>\nto enrollees.&#8221;&nbsp;<\/p>\n<p>A 2019 ruling by the U.S. Preventive Services Task Force<br \/>\n(USPSTF) gave PrEP an &#8220;A&#8221; rating as prevention intervention for<br \/>\npeople at risk of Human Immunodeficiency Virus (HIV). This ruling brought PrEP<br \/>\nunder section 2713 of the Public Health Service Act, which requires insurance<br \/>\ncoverage for services or interventions that have been given an<br \/>\n&#8220;&#8221;A&#8221; or &#8220;B&#8221; rating from the USPSTF.&nbsp;<\/p>\n<p>Subsequent guidance, published by the Centers for Medicare<br \/>\n&amp; Medicaid Services (CMS) in July 2021, further clarified their ruling.<br \/>\nNoting that &#8220;plans and issuers must cover PrEP consistent with the USPSTF<br \/>\nrecommendation without cost sharing,&#8221; the ruling goes on to clarify that<br \/>\nPrEP is not just the medication, but also all of its necessary related services<br \/>\nincluding testing, screening, and provider visits. Despite this ruling and<br \/>\nsubsequent clarification, individuals are still being wrongly charged<br \/>\nout-of-pocket expenses relating to their PrEP care.&nbsp;<\/p>\n<p>&#8220;In light of this clear guidance from CMS, we are<br \/>\nalarmed by continual reports that patients are routinely billed, either for<br \/>\npayment-in-full or for cost-sharing practices, related to medically-appropriate<br \/>\nmedications and essential services,&#8221; they continued. &#8220;These costs can<br \/>\nbe daunting. HIV advocates and clinical workers across the county have reported<br \/>\nthat many patients are unaware that they do not have to pay out-of-pocket for<br \/>\nPrEP and ancillary services, assuming that many of these costs are simply<br \/>\nnecessary for being on PrEP medication.&#8221;&nbsp;<\/p>\n<p>The Senators&#8217; letter highlights the inequities in PrEP<br \/>\nuptake across communities at higher risk for HIV-including Black and Hispanic<br \/>\ncommunities and transgender women-due to limited access to financial resources<br \/>\nneeded to cover costs of PrEP and associated medical visits and laboratory<br \/>\ntests, among other factors.&nbsp;<\/p>\n<p>In light of these concerns, the lawmakers ask the following<br \/>\nquestions and request a response from AHIP within 30 days:&nbsp;<\/p>\n<ol style=\"margin-top:0in\">\n<li>What<br \/>\n     information or guidance is AHIP currently providing to support its members<br \/>\n     in ensuring that their health plans are compliant with federal regulations<br \/>\n     clarifying that PrEP and ancillary services should be available at no-cost<br \/>\n     to patients?&nbsp;<\/li>\n<li>What<br \/>\n     information and educational materials is AHIP recommending that its<br \/>\n     members supply to enrollees to ensure that patients know that PrEP,<br \/>\n     including its ancillary services, should be provided at no-cost to<br \/>\n     enrollees?&nbsp;<\/li>\n<li>How is<br \/>\n     AHIP working with laboratories and health care providers to ensure the<br \/>\n     accurate coding of appointments and services so that enrollees are not<br \/>\n     erroneously billed for these services?&nbsp;<\/li>\n<li>How is<br \/>\n     AHIP working with its partners to develop a full understanding of the<br \/>\n     scope of the issue, both in terms of the number of individuals impacted<br \/>\n     and the monetary impacts of erroneous bills?&nbsp;<\/li>\n<li>How is<br \/>\n     AHIP working with its members to resolve issues for beneficiaries who have<br \/>\n     been wrongfully charged for PrEP and associated services in an expeditious<br \/>\n     manner?&nbsp;<\/li>\n<\/ol>\n<p>The letter is supported by PrEP4ALL, the HIV+Hepatitis<br \/>\nPolicy Institute, the Center for Health and Democracy, and NMAC.&nbsp;<\/p>\n<p>&#8220;Unfortunately we have documented dozens of cases of<br \/>\ninsurers still charging patients out-of-pocket fees for PrEP-related care, a<br \/>\nyear after CMS and the Department of Labor issued their guidance,&#8221; said<br \/>\nKenyon Farrow, Managing Director of Advocacy &amp; Organizing with<br \/>\nPrEP4ALL.?&#8221;Ending the HIV epidemic will require us to ensure everyone with<br \/>\ninsurance be able to get PrEP services with no cost-sharing, as the rule<br \/>\nintended. We applaud Sen. Merkley and Sen. Smith\u2019s tireless advocacy on behalf<br \/>\nof patients.&#8221;&nbsp;<\/p>\n<p>&#8220;We appreciate Senators Merkley and Smith\u2019s leadership<br \/>\nand all their colleagues desire to ensure that the preventative service<br \/>\nprovisions of the Affordable Care Act are properly implemented. Private<br \/>\ninsurers must provide PrEP drugs and associated services without patient<br \/>\ncost-sharing. We are receiving too many complaints from PrEP users that this is<br \/>\nnot always happening.
