{"id":20672,"date":"2024-09-26T11:23:44","date_gmt":"2024-09-26T15:23:44","guid":{"rendered":"https:\/\/www.merkley.senate.gov\/?p=20672"},"modified":"2024-10-10T11:27:46","modified_gmt":"2024-10-10T15:27:46","slug":"merkley-introduces-car-privacy-rights-act-in-bid-to-protect-drivers-data","status":"publish","type":"post","link":"https:\/\/www.merkley.senate.gov\/es\/merkley-introduces-car-privacy-rights-act-in-bid-to-protect-drivers-data\/","title":{"rendered":"Merkley introduces \u2018Car Privacy Rights Act\u2019 in bid to protect drivers\u2019 data"},"content":{"rendered":"<p><a href=\"https:\/\/ktvz.com\/news\/oregon-northwest\/2024\/09\/26\/merkley-introduces-car-privacy-rights-act-in-bid-to-protect-drivers-data\/\" target=\"_blank\" rel=\"noreferrer noopener\">KTVZ<\/a><\/p>\n\n\n\n<p>Oregon Senator Jeff Merkley announced Thursday the introduction of new legislation to protect consumers\u2019 privacy from companies who collect and sell Americans\u2019 car data.<\/p>\n\n\n\n<p>Currently, he said, there is a troubling trend of collecting, storing, and selling data from Americans\u2019 vehicles \u2013 largely without drivers\u2019 knowledge.&nbsp;<a href=\"https:\/\/www.nytimes.com\/2024\/03\/11\/technology\/carmakers-driver-tracking-insurance.html\" target=\"_blank\" rel=\"noreferrer noopener\">Recent reporting<\/a>&nbsp;has even documented automakers selling the data from millions of cars to make billions in profit, including car manufacturers selling consumers\u2019 private data to insurance companies.<\/p>\n\n\n\n<p>\u201cWe need to hit the brakes on big corporations collecting and profiting off of drivers\u2019 data without their consent,\u201d&nbsp;Merkley said.&nbsp;\u201cAutomakers should not have the power to invade our privacy unchecked, and we need strong protections in place to guarantee that Americans\u2019 privacy comes before corporate profits.\u201d<\/p>\n\n\n\n<p>Merkley introduced the<em>&nbsp;Car Privacy Rights Act<\/em>&nbsp;to require any company or third party that collects car data \u2013 including car manufacturers, insurance companies, and digital applications \u2013 to get explicit consent from the consumer to share or sell their data. The bill also requires these entities to provide a clear option to opt-out of the data collection entirely, ensuring consumers are not locked into these predatory practices.<\/p>\n\n\n\n<p>El<em>\u00a0Car Privacy Rights Act\u00a0<\/em>stands up for the privacy of drivers across the nation by:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Banning car manufacturers and other entities from sharing or selling any data collected from a consumer via their vehicle, unless the consumer is clearly notified of each instance of data sharing, its intent, and explicitly grants affirmative, express consent to allow the data transfer.<\/li>\n\n\n\n<li>Requiring all car manufacturers to allow consumers to easily revoke consent to this opt-in directly on their website, applications and direct mail.\n<ul class=\"wp-block-list\">\n<li>This includes an exception for data sharing with the National Highway Traffic Safety Administration\u00a0(NHTSA).<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li>Requiring each car manufacturer and insurance company to annually submit a report to the Federal Trade Commission (FTC) regarding their consumer data privacy practices, data being collected, its purpose, to whom such data is being shared or sold, and an overview of their data sharing practices.\n<ul class=\"wp-block-list\">\n<li>The FTC is required to annually submit a report to Congress regarding such information.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li>Directing the FTC\u2014in partnership with the Federal Communications Commission (FCC) and NHTSA\u2014to issue guidance or promulgate regulations regarding how car manufacturers can address domestic violence issues related to any car applications with geolocation services.<\/li>\n<\/ul>\n\n\n\n<p>El\u00a0<em>Car Privacy Rights Act<\/em>\u00a0is cosponsored by Senator Elizabeth Warren (D-MA).<\/p>","protected":false},"excerpt":{"rendered":"<p>KTVZ Oregon Senator Jeff Merkley announced Thursday the introduction of new legislation to protect consumers\u2019 privacy from companies who collect and sell Americans\u2019 car data.
