Ron Wyden and Jeff Merkley,<br \/>\nD-Ore., and Oregon Attorney General Ellen Rosenblum reacted with dismay to<br \/>\nThursday&#8217;s U.S. Supreme Court ruling that limited how the nation\u2019s main<br \/>\nanti-air pollution law can be used to reduce carbon dioxide emissions from<br \/>\npower plants.<\/p>\n<p>First, Rosenblum&#8217;s statement:<\/p>\n<p>The U.S. Supreme Court dealt another severe blow to our<br \/>\nclimate today in a case that addresses the Obama Administration\u2019s Clean Power<br \/>\nPlan.<\/p>\n<p>\u201cToday\u2019s decision in\u00a0<i>West Virginia v. EPA<\/i>\u2014which<br \/>\nhamstrings the Environmental Protection Agency in its ability to address<br \/>\ngreenhouse gas emissions from power plants under section 111(d) of the federal<br \/>\nClean Air Act\u2014is deeply disturbing. That\u2019s because reducing power plant<br \/>\nemissions is an essential part of addressing our climate crisis,\u201d said Oregon<br \/>\nAttorney General Ellen Rosenblum.<\/p>\n<p>Oregon has been involved in this litigation over the EPA\u2019s<br \/>\nright to regulate greenhouse gases from power plants since 2015.\u00a0Together<br \/>\nwith a coalition of states, Oregon successfully challenged the Trump<br \/>\nAdministration\u2019s repeal of the Clean Power Plan, an Obama-era regulation<br \/>\nlimiting emissions from existing power plants.<\/p>\n<p>What makes this radical act by the Court so blatant: There<br \/>\nis no federal rule currently in effect for coal companies and Republican-led<br \/>\nstates to challenge\u2014the Clean Power Plan had never gone into effect. Perhaps<br \/>\nmore telling: Not a single power company petitioned the Court for review. In<br \/>\nfact, several of the nation\u2019s biggest power companies opposed the review.<\/p>\n<p>\u201cThis ruling,\u201d said Rosenblum, \u201cis another reminder we are<br \/>\ndealing with a new Supreme Court where a majority of the justices have<br \/>\ndemonstrated little regard for past legal precedent.\u00a0This chilling ruling<br \/>\ncurtails the federal government\u2019s ability to protect us from greenhouse gases<br \/>\nand carbon emissions under this part of the Clean Air Act.\u00a0I will continue<br \/>\nto work hand-in-hand with like-minded state AGs on strategies to mitigate<br \/>\nclimate harms in a comprehensive manner at both the federal and state levels.\u201d<\/p>\n<p>\u201cWe will not be derailed,\u201d Rosenblum added.\u00a0 \u201cOur<br \/>\nfuture\u2014and our children\u2019s and grandchildren\u2019s\u2014depends on stepping up this<br \/>\ncritical work and never giving up.\u201d<\/p>\n<div style=\"text-align:center\" align=\"center\">\n<hr align=\"center\">\n<\/div>\n<p>Sen. The only way to tackle this problem is<br \/>\nthrough congressional action, which is why it\u2019s so important that Congress<br \/>\npass\u00a0our clean energy tax credit package.\u201d<\/p>\n<div style=\"text-align:center\" align=\"center\">\n<hr align=\"center\">\n<\/div>\n<p><b>Merkley: Supreme Court Decision Guts EPA\u2019s Authority to<br \/>\nCombat Climate Chaos<\/b><\/p>\n<p>WASHINGTON, D.C.\u00a0\u2013\u00a0Today, Oregon\u2019s U.S. Senator<br \/>\nJeff Merkley issued the following statement after the US Supreme Court released<br \/>\ntheir decision in\u00a0<i>West Virginia contra la Agencia de Protecci\u00f3n Ambiental<\/i>\u00a0(EPA):<\/p>\n<p>\u201cThe American people don\u2019t want dirty air, extreme weather,<br \/>\nand climate chaos. But that is what the right-wing Supreme Court majority is<br \/>\nforcing on us by once again doing fossil fuel executives\u2019 bidding, even at the<br \/>\nexpense of judicial precedent, common sense, and our shared future.<\/p>\n<p>\u201cAir pollution is a lethal threat, which is why Congress<br \/>\npassed a law giving the EPA the responsibility for reducing pollution. Fossil<br \/>\nfuel companies may want to prioritize their profits ahead of kids\u2019 health,<br \/>\nfarmers\u2019 livelihoods, working families\u2019 homes, and our national security\u2014but<br \/>\nit\u2019s unconscionable for justices handpicked by the Federalist Society to go to<br \/>\nextreme lengths to help them do it. It\u2019s particularly egregious that the<br \/>\nCourt\u2019s conservative majority would violate centuries of precedent by going out<br \/>\nof its way to consider this case when there\u2019s no pending EPA rule to even<br \/>\nstrike down.\u00a0 It\u2019s a testament to how far they will bend the rules to<br \/>\nserve the corporate interests who financed their dark money confirmation<br \/>\ncampaigns, and to how far they have dragged down the once-great institution of<br \/>\nthe Court.<\/p>\n<p>\u201cWhile climate chaos is an existential threat to our way of<br \/>\nlife, this decision is about even more. It\u2019s the latest in a long line of<br \/>\ndangerous decisions by an extremist Court to roll back fundamental protections<br \/>\nfor Americans. The Supreme Court is replacing government \u2018of, by, and for the<br \/>\npeople,\u2019 with \u2018of, by and for the powerful.\u2019\u00a0Today\u2019s decision is an<br \/>\negregious giveaway to powerful corporations at the expense of the people, but<br \/>\nwe will not stop fighting to protect our health, our democracy and our future.\u201d<\/p>\n<p>Merkley \u2013 a member of the Senate Environment and Public<br \/>\nWorks Committee \u2013 joined more than 190 Congressional Democrats in\u00a0<a href=\"https:\/\/www.epw.senate.gov\/public\/index.cfm\/2022\/1\/190-congressional-democrats-file-amicus-brief-defending-epa-s-clean-air-act-authority\">submitting<br \/>\nan amicus brief<\/a>\u00a0to the Supreme Court that supported the EPA\u2019s<br \/>\nauthority under the Clean Air Act to protect the public from harmful pollution,<br \/>\nreduce greenhouse gas emissions, and address climate chaos.\u00a0<\/p>\n<div style=\"text-align:center\" align=\"center\">\n<hr align=\"center\">\n<\/div>\n<p>Today, in response to the Supreme Court ruling in West<br \/>\nVirginia v. Furthermore, the Oregon<br \/>\nlegislature has acted to curtail carbon emissions from power plants that supply<br \/>\nelectricity to Oregonians, and this state program is also unaffected by today\u2019s<br \/>\ndecisi\u00f3n.<\/p>\n<p>\u201cIn short, Oregon, along with other partner states, will<br \/>\ncontinue to lead the nation in demonstrating how to combat climate change. What<br \/>\nthe court\u2019s ruling does do, however, is create an uneven playing field across<br \/>\nthe country, with some states shouldering the weight of responsible climate<br \/>\nactions and others not doing so.
