SALEM, Ore. (KTVZ) — Sens. Ron Wyden and Jeff Merkley,
\nD-Ore., and Oregon Attorney General Ellen Rosenblum reacted with dismay to
\nThursday’s U.S. Supreme Court ruling that limited how the nation\u2019s main
\nanti-air pollution law can be used to reduce carbon dioxide emissions from
\npower plants.<\/p>\n

First, Rosenblum’s statement:<\/p>\n

The U.S. Supreme Court dealt another severe blow to our
\nclimate today in a case that addresses the Obama Administration\u2019s Clean Power
\nPlan.<\/p>\n

\u201cToday\u2019s decision in\u00a0West Virginia v. EPA<\/i>\u2014which
\nhamstrings the Environmental Protection Agency in its ability to address
\ngreenhouse gas emissions from power plants under section 111(d) of the federal
\nClean Air Act\u2014is deeply disturbing. That\u2019s because reducing power plant
\nemissions is an essential part of addressing our climate crisis,\u201d said Oregon
\nAttorney General Ellen Rosenblum.<\/p>\n

Oregon has been involved in this litigation over the EPA\u2019s
\nright to regulate greenhouse gases from power plants since 2015.\u00a0Together
\nwith a coalition of states, Oregon successfully challenged the Trump
\nAdministration\u2019s repeal of the Clean Power Plan, an Obama-era regulation
\nlimiting emissions from existing power plants.<\/p>\n

What makes this radical act by the Court so blatant: There
\nis no federal rule currently in effect for coal companies and Republican-led
\nstates to challenge\u2014the Clean Power Plan had never gone into effect. Perhaps
\nmore telling: Not a single power company petitioned the Court for review. In
\nfact, several of the nation\u2019s biggest power companies opposed the review.<\/p>\n

\u201cThis ruling,\u201d said Rosenblum, \u201cis another reminder we are
\ndealing with a new Supreme Court where a majority of the justices have
\ndemonstrated little regard for past legal precedent.\u00a0This chilling ruling
\ncurtails the federal government\u2019s ability to protect us from greenhouse gases
\nand carbon emissions under this part of the Clean Air Act.\u00a0I will continue
\nto work hand-in-hand with like-minded state AGs on strategies to mitigate
\nclimate harms in a comprehensive manner at both the federal and state levels.\u201d<\/p>\n

\u201cWe will not be derailed,\u201d Rosenblum added.\u00a0 \u201cOur
\nfuture\u2014and our children\u2019s and grandchildren\u2019s\u2014depends on stepping up this
\ncritical work and never giving up.\u201d<\/p>\n

Sen. Ron Wyden’s statement:<\/p>\n

\u201cThe Supreme Court\u2019s effort to protect polluters that spew
\npoison into our air and water continues apace. The Republicans on the Supreme
\nCourt are not going to allow any meaningful administration efforts to combat
\nclimate change. It\u2019s crystal clear. The only way to tackle this problem is
\nthrough congressional action, which is why it\u2019s so important that Congress
\npass\u00a0our clean energy tax credit package.\u201d<\/p>\n

Merkley: Supreme Court Decision Guts EPA\u2019s Authority to
\nCombat Climate Chaos<\/b><\/p>\n

WASHINGTON, D.C.\u00a0\u2013\u00a0Today, Oregon\u2019s U.S. Senator
\nJeff Merkley issued the following statement after the US Supreme Court released
\ntheir decision in\u00a0West Virginia contra la Agencia de Protecci\u00f3n Ambiental<\/i>\u00a0(EPA):<\/p>\n

\u201cThe American people don\u2019t want dirty air, extreme weather,
\nand climate chaos. But that is what the right-wing Supreme Court majority is
\nforcing on us by once again doing fossil fuel executives\u2019 bidding, even at the
\nexpense of judicial precedent, common sense, and our shared future.<\/p>\n

\u201cAir pollution is a lethal threat, which is why Congress
\npassed a law giving the EPA the responsibility for reducing pollution. Fossil
\nfuel companies may want to prioritize their profits ahead of kids\u2019 health,
\nfarmers\u2019 livelihoods, working families\u2019 homes, and our national security\u2014but
\nit\u2019s unconscionable for justices handpicked by the Federalist Society to go to
\nextreme lengths to help them do it. It\u2019s particularly egregious that the
\nCourt\u2019s conservative majority would violate centuries of precedent by going out
\nof its way to consider this case when there\u2019s no pending EPA rule to even
\nstrike down.\u00a0 It\u2019s a testament to how far they will bend the rules to
\nserve the corporate interests who financed their dark money confirmation
\ncampaigns, and to how far they have dragged down the once-great institution of
\nthe Court.<\/p>\n

\u201cWhile climate chaos is an existential threat to our way of
\nlife, this decision is about even more. It\u2019s the latest in a long line of
\ndangerous decisions by an extremist Court to roll back fundamental protections
\nfor Americans. The Supreme Court is replacing government \u2018of, by, and for the
\npeople,\u2019 with \u2018of, by and for the powerful.\u2019\u00a0Today\u2019s decision is an
\negregious giveaway to powerful corporations at the expense of the people, but
\nwe will not stop fighting to protect our health, our democracy and our future.\u201d<\/p>\n

Merkley \u2013 a member of the Senate Environment and Public
\nWorks Committee \u2013 joined more than 190 Congressional Democrats in\u00a0submitting
\nan amicus brief<\/a>\u00a0to the Supreme Court that supported the EPA\u2019s
\nauthority under the Clean Air Act to protect the public from harmful pollution,
\nreduce greenhouse gas emissions, and address climate chaos.\u00a0<\/p>\n

Today, in response to the Supreme Court ruling in West
\nVirginia v. Environmental Protection Agency,\u00a0Oreg\u00f3n
\nDepartment of Environmental Quality<\/a>\u00a0Director Richard Whitman has

\nOregon legislature rather than by the U.S. Congress and as a result, are not
\naffected by the West Virginia v. EPA decision. Furthermore, the Oregon
\nlegislature has acted to curtail carbon emissions from power plants that supply
\nelectricity to Oregonians, and this state program is also unaffected by today\u2019s
\ndecisi\u00f3n.<\/p>\n

\u201cIn short, Oregon, along with other partner states, will
\ncontinue to lead the nation in demonstrating how to combat climate change. What
\nthe court\u2019s ruling does do, however, is create an uneven playing field across
\nthe country, with some states shouldering the weight of responsible climate
\nactions and others not doing so. Addressing that inequity will ultimately
\nrequire Congressional action to move the nation forward as a whole to meet our
