{"id":21397,"date":"2025-02-03T13:32:56","date_gmt":"2025-02-03T18:32:56","guid":{"rendered":"https:\/\/www.merkley.senate.gov\/?p=21397"},"modified":"2025-02-11T15:26:31","modified_gmt":"2025-02-11T20:26:31","slug":"merkley-and-colleagues-to-epa-administrator-zeldin-provide-valid-legal-basis-for-epa-funding-freeze-that-is-threatening-jobs-and-jeopardizing-infrastructure-projects","status":"publish","type":"post","link":"https:\/\/www.merkley.senate.gov\/es\/merkley-and-colleagues-to-epa-administrator-zeldin-provide-valid-legal-basis-for-epa-funding-freeze-that-is-threatening-jobs-and-jeopardizing-infrastructure-projects\/","title":{"rendered":"Merkley and Colleagues to EPA Administrator Zeldin: Provide Valid Legal Basis for EPA Funding Freeze that is Threatening Jobs and Jeopardizing Infrastructure Projects"},"content":{"rendered":"\n<p class=\"has-text-align-center\"><em>During his first days on the job, EPA Administrator Zeldin rubber stamps Trump\u2019s disastrous funding freeze and violates federal law<\/em><em><\/em><\/p>\n\n\n\n<p>Washington, D.C. \u2013 Oregon\u2019s U.S. Senator Jeff Merkley\u2014a senior member of the Senate Environment and Public Works (EPW) Committee\u2014joined all his Democratic colleagues of the Committee in demanding answers from recently-confirmed Environmental Protection Agency (EPA) Administrator Lee Zeldin about the agency\u2019s freezing of Congressionally appropriated funds, including those that have already been obligated.\u00a0 According to\u00a0<a href=\"https:\/\/subscriber.politicopro.com\/article\/eenews\/2025\/01\/30\/epa-cuts-off-ira-solar-money-thats-under-contract-ew-00201321\" target=\"_blank\" rel=\"noreferrer noopener\">public reporting<\/a>, the EPA sent letters to grant recipients explaining it was pausing \u201call funding actions related to\u201d the\u00a0<em>Inflation Reduction Act<\/em>\u00a0and the\u00a0<em>Bipartisan Infrastructure Law<\/em>.\u00a0Not only are these funding cuts already having devastating effects on communities, with reports of jobs in\u00a0<a href=\"https:\/\/www.eenews.net\/articles\/funding-freeze-hits-water-programs-once-backed-by-trump-zeldin\/\" target=\"_blank\" rel=\"noreferrer noopener\">jeopardy<\/a>\u00a0and essential infrastructure projects on the\u00a0<a href=\"https:\/\/nevadacurrent.com\/briefs\/nevada-loses-access-to-156m-in-community-solar-funds-thanks-to-trumps-ira-clawback-order\/\" target=\"_blank\" rel=\"noreferrer noopener\">chopping block<\/a>, but failing to allow grant recipients to access funds that have already been obligated violates federal law.<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>\u201cWe write concerning troubling reports that the Environmental Protection Agency is attempting to claw back funds that have already been obligated to grant recipients.&nbsp; We believe that this is contrary to federal law,\u201d&nbsp;<strong>wrote Senator Merkley and other members of the Senate Environment and Public Works Committee.<\/strong>&nbsp;\u201cMany of us have also been contacted by grantees in our states reporting that they no longer have access to the grant money that has been obligated to them.\u201d<\/p>\n<\/blockquote>\n\n\n\n<p>The Senators further pressed Administrator Zeldin on his failure to abide by the commitments he made to Members of the Committee during his confirmation hearing.&nbsp; When asked if he believed the president or executive branch could ignore congressional appropriation decisions and instructions, then-nominee Zeldin responded, \u201cIf confirmed, I pledge to respect all of Congress\u2019s duly enacted statutes.\u201d&nbsp; When asked if he pledged to respect congressional appropriation decisions and instructions and resist any efforts within the executive branch to circumvent them, he reaffirmed his commitment to executing on EPA\u2019s mission and recognized Congress\u2019s power of the purse, stating \u201cParticularly as a former Member of Congress, I appreciate and respect the Congressional funding process. I commit to fully following the law.\u201d<\/p>\n\n\n\n<p>But it appears that in his first days as EPA Administrator, Zeldin is already allowing President Trump to pull the strings at EPA by failing swiftly to address these funding freezes that undermine EPA\u2019s core mission and run contrary to federal law.&nbsp;<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>\u201cFederal law and regulations require that obligated funds be provided to grantees absent proof of misuse of funds,\u201d&nbsp;<strong>wrote the Senators.<\/strong>&nbsp; \u201cWe further note that the Solar for All program furthers several goals, all of which are part of EPA\u2019s core mission, which you support.&nbsp; It is designed to help reduce carbon pollution, air pollutants, and household energy costs by financing community and rooftop solar in low-income communities.&nbsp; It will further help drive American manufacturing, boosting the economy and creating jobs.\u201d&nbsp;<\/p>\n<\/blockquote>\n\n\n\n<p>Accordingly, the Senators demanded that Administrator Zeldin provide a valid legal justification for the funding freezes and explain when he plans restore the availability of the funds to grant recipients.<\/p>\n\n\n\n<p>The text of the letter is below, and a full version (with\u00a0footnotes) is available\u00a0<a href=\"https:\/\/www.epw.senate.gov\/public\/_cache\/files\/0\/c\/0c0ec2a9-1658-4847-8d00-00e9d6c30a6c\/5ACA44EF9A9C063048370A296A23507C5F371275A2803483B747BCF305144A0A.1.31.2025-letter-to-administrator-zeldin-re-grant-pauses.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">here<\/a>.<\/p>\n\n\n\n<p>Dear Administrator Zeldin:<\/p>\n\n\n\n<p>We write concerning troubling reports that the Environmental Protection Agency (EPA) is attempting to claw back funds that have already been obligated to grant recipients. We believe that this is contrary to federal law.<\/p>\n\n\n\n<p>On January 30, 2025,&nbsp;<em>Politico<\/em>\u2019s&nbsp;<em>E&amp;E News&nbsp;<\/em>reported that the EPA had sent letters two days prior to recipients of funding through the Solar for All program informing them that their grants had been paused until further notice. EPA\u2019s letter went on to explain that it was pausing \u201call funding actions related to\u201d climate and infrastructure laws enacted during the Biden Administration, citing President Donald J. Trump\u2019s \u201cUnleashing American Energy\u201d Executive Order. Many of us have also be contacted by grantees in our states reporting that they no longer have access to the grant money that has been obligated to them.<\/p>\n\n\n\n<p>During your confirmation before the Senate Environment and Public Works Committee, you were asked:<\/p>\n\n\n\n<p>\u201cSeveral statutes give effect to Congress\u2019s constitutional power of the purse, reflecting its responsibility to provide appropriations to federal agencies, and its prerogative to place limitations on the availability of those appropriations, specifically, their availability as to purpose, amount, and time. Among these, the Antideficiency Act prohibits agencies from spending in advance, or in excess, of an appropriation. There is also a statutory framework for the execution \u2013 that is, the obligation and expenditure \u2013 of appropriations, as well as procedures for use when the President or executive branch disagrees with the policy embodied in an appropriation and therefore does not wish to obligate available funds. Even President Trump\u2019s Department of Energy continues to acknowledge that \u201c[i]nvesting in energy innovations creates well-paying jobs, drives economic growth, and makes our industries more competitive,\u201d and that the \u201cgrowing global market for renewable energy technologies and innovations is projected to be worth at least $23 trillion by 2030.\u201d<\/p>\n\n\n\n<p>Accordingly, in order to assist in our understanding of EPA\u2019s actions, please respond to the following questions:<\/p>\n\n\n\n<ol class=\"wp-block-list\" start=\"1\">\n<li>On what legal grounds did EPA pause already-obligated grants to grantees under the Solar for All program? Please cite to specific statutory or regulatory authority. We note that any executive orders do not qualify as such statutory or regulatory authority, as they are neither statutes nor regulations, and all potentially relevant executive orders clearly state in any case that they \u201cshall be implemented consistent with applicable law,\u201d thereby clearly acknowledging that they cannot supersede or contravene statutory authority.<\/li>\n\n\n\n<li>When do you intend to lift the pause on the already-obligated funding under this program?<\/li>\n\n\n\n<li>As many of our offices have also received reports of other EPA grant programs that seem to have been \u201cpaused\u201d or where obligated funds may have been cut off, please provide us a list of all EPA grant and other programs that are currently paused. Please further note whether this pause applies only to future grant-making, to post- award but pre-obligation grants, and\/or to already obligated grants.<\/li>\n\n\n\n<li>For each of these programs, when do you intend to lift the pause(s)?<\/li>\n<\/ol>\n\n\n\n<p>We are cognizant that EPA\u2019s initial decision to pause funding appears to have been taken before you had been confirmed as EPA Administrator. Perhaps you intend to reverse this pause immediately in accordance with applicable law.
