{"id":23084,"date":"2025-09-23T21:59:00","date_gmt":"2025-09-24T01:59:00","guid":{"rendered":"https:\/\/www.merkley.senate.gov\/?p=23084"},"modified":"2025-09-24T10:01:02","modified_gmt":"2025-09-24T14:01:02","slug":"whitehouse-van-hollen-merkley-probe-exxonmobils-guyana-offshore-oil-contract-and-the-companys-u-s-tax-liability","status":"publish","type":"post","link":"https:\/\/www.merkley.senate.gov\/es\/whitehouse-van-hollen-merkley-probe-exxonmobils-guyana-offshore-oil-contract-and-the-companys-u-s-tax-liability\/","title":{"rendered":"Whitehouse, Van Hollen, Merkley Probe ExxonMobil\u2019s Guyana Offshore Oil Contract and the Company\u2019s U.S. Tax Liability"},"content":{"rendered":"\n<p class=\"has-text-align-center\"><strong><em>ExxonMobil may have used American taxpayer funds to subsidize its foreign oil production, which it does in partnership with a Chinese state-owned company<\/em><\/strong><\/p>\n\n\n\n<p><em>Washington, DC<\/em> \u2013 U.S. Senators Sheldon Whitehouse (D-RI), Chris Van Hollen (D-MD), and Jeff Merkley (D-OR) sent a <a href=\"https:\/\/www.whitehouse.senate.gov\/wp-content\/uploads\/2025\/09\/Letter-to-ExxonMobil-on-Guyana-Oil-Contract.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">letter<\/a> today to ExxonMobil CEO Darren Woods asking for information on the company\u2019s accounting of its U.S. tax liability as a result of the 2016 Stabroek Block Petroleum Agreement.\u00a0 The letter raises questions about whether American taxpayers are subsidizing ExxonMobil\u2019s foreign oil production in Guyana, which the company carries out in partnership with a Chinese state-owned company.\u00a0<\/p>\n\n\n\n<p>Current U.S. tax rules offer a loophole for big multinational oil companies drilling in a foreign country to shrink their tax bills.&nbsp; Closing this loophole would save American taxpayers an estimated $71.5 billion over ten years.<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p><strong>\u201cWe are concerned about the possibility that American taxpayers may be subsidizing ExxonMobil\u2019s foreign oil production, which they do in partnership with a Chinese state-owned company,\u201d <\/strong>wrote Whitehouse, Van Hollen, and Merkley.<strong><\/strong><\/p>\n<\/blockquote>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p><strong>\u201cPayments to a foreign government in exchange for an economic benefit [such as the right to extract oil and gas] are not considered taxes at all and thus cannot qualify for a U.S. foreign tax credit.&nbsp; However special rules allow \u2018dual capacity\u2019 taxpayers to divide up such payments into creditable taxes and non-creditable payments.&nbsp; While it is not difficult to distinguish between taxes and payments for economic benefits, current rules allow contracts to be structured in a way that blurs the distinction.&nbsp; This loophole is a particular boon to big multinational oil companies,\u201d <\/strong>added the senators.<strong><\/strong><\/p>\n<\/blockquote>\n\n\n\n<p>According to a 2021 IMF report, U.S. effectively subsidizes Big Oil and the fossil fuel industry to over $600 billion annually.\u00a0 Congressional Republicans added even more subsidies with their Beautiful-for-Billionaires bill, which included a $167 billion tax giveaway to companies like ExxonMobil that ship jobs and profits overseas.\u00a0 In February, Whitehouse and Rep.
