{"id":24986,"date":"2026-06-25T15:40:51","date_gmt":"2026-06-25T19:40:51","guid":{"rendered":"https:\/\/www.merkley.senate.gov\/?p=24986"},"modified":"2026-06-25T15:41:25","modified_gmt":"2026-06-25T19:41:25","slug":"merkley-bipartisan-senators-reintroduce-cannabis-banking-reform","status":"publish","type":"post","link":"https:\/\/www.merkley.senate.gov\/es\/merkley-bipartisan-senators-reintroduce-cannabis-banking-reform\/","title":{"rendered":"Merkley, Bipartisan Senators Reintroduce Cannabis Banking Reform"},"content":{"rendered":"<p>Washington, D.C. \u2013 Today, Oregon\u2019s U.S. Senator Jeff Merkley led a bipartisan group of Senators to reintroduce his legislation that would ensure state-legal cannabis businesses can access traditional and secure banking systems and financial services.<\/p>\n\n\n\n<p>Even with the recent federal <a href=\"https:\/\/www.merkley.senate.gov\/es\/merkley-now-is-the-time-for-bipartisan-action-on-commonsense-cannabis-reforms\/\" target=\"_blank\" rel=\"noreferrer noopener\">reclassification of cannabis from Schedule I to Schedule III at the federal level,<\/a> the bipartisan <em>Secure and Fair Enforcement (SAFE) Banking Act of 2026<\/em> is necessary to provide legal clarity for financial institutions to adequately serve state-legal medicinal or recreational cannabis businesses and ensure the safety of our communities. Merkley\u2019s <em>SAFE Banking Act of 2026 <\/em>would provide a common-sense solution by creating a legal framework for banking and financial services to offer state-legal cannabis businesses access to these critical services, reducing cash in communities nationwide, and improving public safety.<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p><strong>\u201cLegal cannabis businesses operating in all-cash is dangerous for our communities\u2014encouraging criminal activity like robberies, money laundering, and organized crime. It\u2019s past time we ensure legal businesses can access the financial services they need to help keep their employees, their businesses, and their communities safe,\u201d<\/strong> dijo Merkley.<strong> &quot;El <em>Ley de Banca Segura<\/em> is a common-sense, bipartisan solution, and I\u2019ll keep working with both Republicans and Democrats to advance this reform.\u201d<\/strong><\/p>\n<\/blockquote>\n\n\n\n<p>el bipartidista <em>SAFE Banking Act of 2026 <\/em>har\u00eda:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Prohibit, penalize, or discourage a bank from providing financial services to a legitimate state-sanctioned and regulated cannabis business, or an associated business (such as a lawyer or landlord providing services to a legal cannabis business);<\/li>\n\n\n\n<li>Terminate or limit a bank\u2019s federal deposit insurance primarily because the bank is providing services to a state-sanctioned cannabis business or associated business;<\/li>\n\n\n\n<li>Recommend or incentivize a bank to halt or downgrade providing any kind of banking services to these businesses or take any action on a loan to an owner or operator of a cannabis-related business;<\/li>\n\n\n\n<li>Create a safe harbor from criminal prosecution and liability and asset forfeiture for banks and their officers and employees who provide financial services to legitimate, state-sanctioned cannabis businesses, while maintaining banks\u2019 right to choose not to offer those services;<\/li>\n\n\n\n<li>Provide protections for hemp and hemp-derived cannabidiol (CBD) related businesses; and<\/li>\n\n\n\n<li>Require banks to comply with current Financial Crimes Enforcement Network (FinCEN) guidance, while at the same time allowing FinCEN guidance to be streamlined over time as states and the federal government adapt to legalized medicinal and recreational cannabis policies.<\/li>\n<\/ul>\n\n\n\n<p><\/p>\n\n\n\n<p>Merkley has been a fierce and longtime leader advocating for sensible <a href=\"https:\/\/www.merkley.senate.gov\/es\/merkley-statement-on-cannabis-rescheduling\/\" target=\"_blank\" rel=\"noreferrer noopener\">cannabis reform<\/a>. As a senior member of the Senate Appropriations Committee, he has also&nbsp;<a href=\"https:\/\/www.merkley.senate.gov\/es\/merkley-senators-urge-va-to-expand-access-to-medical-cannabis-for-americas-veterans\/\" target=\"_blank\" rel=\"noreferrer noopener\">led the fight for over a decade for veterans to be able to discuss medical cannabis programs with their doctors<\/a>&nbsp;at the U.S. Department of Veterans Affairs (VA) in states with medical cannabis programs.<\/p>\n\n\n\n<p>El <em>SAFE Banking Act of 2026<\/em> is cosponsored by U.S. Senators Lisa Murkowski (R-AK), Steve Daines (R-MT), and Elizabeth Warren (D-MA)\u2014Ranking Member of the Senate Banking, Housing, and Urban Affairs Committee.<\/p>\n\n\n\n<p>U.S. Congressman David Joyce (R-OH-14) is leading the introduction of the <em>SAFE Banking Act of 2026 <\/em>in the House of Representatives. Previously, the <em>Ley de Banca Segura<\/em> passed the House seven times with strong bipartisan support, and <a href=\"https:\/\/www.forbes.com\/sites\/ajherrington\/2024\/09\/09\/trump-backs-federal-marijuana-rescheduling-and-cannabis-banking-bill\/\" target=\"_blank\" rel=\"noreferrer noopener\">then-candidate Donald Trump<\/a> stated he supported cannabis banking reform.<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p><strong>\u201cWe applaud today\u2019s re-introduction of the <em>SAFE Banking Ac<\/em>t and urge Congress to advance this bipartisan legislation so banks can finally provide financial services to state-licensed cannabis businesses, as well as the growing number of accountants, skilled trades, landlords, law firms, and other service providers they rely on to do business. For years, the conflict between state and federal cannabis laws has left many cannabis businesses operating in cash, creating significant public safety risks in states where it&#8217;s been legalized.
