Washington <\/strong>– Today, Oregon’s Senator Jeff Merkley introduced an amendment to the comprehensive immigration reform bill that would tighten restrictions on a visa program that was used to hire foreign workers at the expense of Oregon forest workers. The amendment is similar to a bill he offered earlier this year called “The American Jobs in American Forests Act.”<\/p>\n

En 2011, el Inspector General del Departamento de Trabajo de los EE. UU. public\u00f3 una auditor\u00eda que documentaba c\u00f3mo se utilizaron millones de d\u00f3lares en fondos de la Ley de Recuperaci\u00f3n y Reinversi\u00f3n de los Estados Unidos para emplear a trabajadores extranjeros en proyectos de reducci\u00f3n de bosques destinados a trabajadores madereros desempleados de Oreg\u00f3n. “I am pleased that the Senate is moving forward to fix our broken immigration system,” said Merkley. “But we need to ensure that in fields like forestry where there are thousands of Oregonians looking for work, companies are not allowed to abuse the H-2B visa program and just blindly assert that there are no Oregonians willing and able to work in our forests.”<\/p>\n<\/blockquote>\n

El programa de visa H-2B permite a los empleadores contratar temporalmente a trabajadores extranjeros si pueden establecer que ning\u00fan estadounidense est\u00e1 calificado o disponible para el trabajo. En el caso de los contratistas involucrados con los fondos de est\u00edmulo de 2009, no se hizo ning\u00fan esfuerzo significativo para contratar a habitantes de Oreg\u00f3n.  <\/p>\n

Merkley solicit\u00f3 previamente al Departamento de Trabajo, la Oficina de Administraci\u00f3n y Presupuesto y el Servicio Forestal de EE. UU. que hicieran cambios en la forma en que se administra el programa y c\u00f3mo el Servicio Forestal supervisa a los contratistas que realizan trabajos en los bosques federales.  <\/p>\n

The amendment would make three key changes to the DOL’s H-2B visa program for forest workers:<\/p>\n

1)      Reclutamiento mejorado<\/strong>: Los empleadores, antes de presentar una petici\u00f3n para contratar trabajadores H-2B, tendr\u00edan que realizar un reclutamiento s\u00f3lido de trabajadores estadounidenses, incluida la publicidad en ferias de trabajo, con agencias de mano de obra locales y estatales y organizaciones sin fines de lucro (y otras entidades apropiadas), publicidad en la radio local y Sitios de b\u00fasqueda de empleo en Internet y otras estrategias de contrataci\u00f3n que la agencia estatal de fuerza laboral considere apropiadas. <\/p>\n

2)      Agencias Estatales de Empleo<\/strong>: Antes de que el Secretario del Trabajo pueda otorgar una certificaci\u00f3n laboral temporal a un empleador para contratar trabajadores H-2B, el Director de la agencia laboral estatal debe certificar que el empleador ha cumplido con todos los requisitos de contrataci\u00f3n y debe determinar formalmente que los nacionales del Estados Unidos no est\u00e1n calificados o disponibles para ocupar las oportunidades de empleo que ofrece el posible empleador H-2B.  <\/p>\n

3)      Itinerarios que cubren varios estados:<\/strong> Si un empleador busca obtener la certificaci\u00f3n para un itinerario de trabajo que cubre varios estados y si el trabajo fuera del estado primario dura 7 d\u00edas o m\u00e1s, el empleador deber\u00e1 presentar una solicitud por separado para el trabajo planificado en el otro estado o estados.<\/p>\n

Seg\u00fan el Departamento de Empleo de Oregon, la base de datos de buscadores de empleo de Oregon incluye 3492 trabajadores forestales y de conservaci\u00f3n y 1489 t\u00e9cnicos forestales y de conservaci\u00f3n que buscan trabajo activamente.<\/p>\n
