{"id":6773,"date":"2010-05-10T14:52:00","date_gmt":"2010-05-10T18:52:00","guid":{"rendered":"https:\/\/www.merkley.senate.gov\/merkley-amendment-stops-foreign-companies-from-dodging-state-insurance-regulations\/"},"modified":"2023-07-24T11:11:19","modified_gmt":"2023-07-24T15:11:19","slug":"merkley-amendment-stops-foreign-companies-from-dodging-state-insurance-regulations","status":"publish","type":"post","link":"https:\/\/www.merkley.senate.gov\/es\/merkley-amendment-stops-foreign-companies-from-dodging-state-insurance-regulations\/","title":{"rendered":"La enmienda Merkley impide que las empresas extranjeras eludan las regulaciones estatales de seguros"},"content":{"rendered":"<p><strong>WASHINGTON DC<\/strong> El senador estadounidense Jeff Merkley present\u00f3 hoy una enmienda que mejorar\u00e1 las disposiciones de la Oficina Nacional de Seguros (ONI, por sus siglas en ingl\u00e9s) del proyecto de ley de reforma de Wall Street para garantizar que las aseguradoras estadounidenses y extranjeras operen en igualdad de condiciones a nivel internacional sin debilitar involuntariamente la regulaci\u00f3n estatal de seguros.&nbsp;&nbsp;<\/p>\n<blockquote><p>\u201cA medida que aumentamos la rendici\u00f3n de cuentas en Wall Street, debemos tener cuidado de no vulnerar el derecho de los estados a mantener una s\u00f3lida regulaci\u00f3n de los seguros\u201d, declar\u00f3 Merkley. \u201cEsta enmienda salvaguarda la solvencia de las aseguradoras y permite la celebraci\u00f3n de acuerdos internacionales, al tiempo que protege a los consumidores y a las empresas estadounidenses\u201d.\u201d<\/p><\/blockquote>\n<p>En concreto, la enmienda del senador Merkley propondr\u00eda lo siguiente:<\/p>\n<p>\u2022 Permitir que la ONI participe en conversaciones internacionales sobre regulaci\u00f3n de seguros, incluidas las relativas a las normas de solvencia, garantizando al mismo tiempo que la ONI no pueda suscribir acuerdos que debiliten la regulaci\u00f3n estatal de los seguros.&nbsp; <\/p>\n<p>\u2022 Aclarar que la ONI estar\u00eda facultada para anular las leyes estatales y permitir que las aseguradoras no estadounidenses operen en los mercados estadounidenses solo si una ley estatal discrimina directamente contra las aseguradoras no estadounidenses y la ONI ha celebrado un acuerdo que reconoce que el est\u00e1ndar bajo el cual la aseguradora no estadounidense fue regulada en su jurisdicci\u00f3n de origen cumple con los objetivos del est\u00e1ndar estadounidense en cuesti\u00f3n.<\/p>\n<p>\u2022 Aclarar que solo los acuerdos celebrados despu\u00e9s de la aprobaci\u00f3n del proyecto de ley de reforma financiera podr\u00edan servir de base para la primac\u00eda de la ley federal, garantizando as\u00ed que los pactos de desregulaci\u00f3n firmados con anterioridad no tengan poder de primac\u00eda.<\/p>\n<p>\u2022 Requiere consulta con el Congreso, los comisionados estatales de seguros y el p\u00fablico. Asimismo, otorga a los estados la capacidad de impugnar ante los tribunales estadounidenses la validez de las decisiones de preeminencia de la ONI.<\/p>\n<p>La enmienda del senador Merkley cuenta con el apoyo de la Asociaci\u00f3n Nacional de Comisionados de Seguros, Public Citizen, PIRG, Consumer Watchdog y otras organizaciones.<\/p>","protected":false},"excerpt":{"rendered":"<p>WASHINGTON, D.C. &ndash;
